Libanon Mugraby begint procedure bij Europees Hof

Op 27 juli 2009 is de prominente Libanese mensenrechtenadvocaat dr. Muhamad Mugraby een juridische procedure gestart tegen de EU bij het Europees Hof van Justitie. Daarbij beroept hij zich op art. 2 van het Associatieverdrag tussen Libanon en de EU, de zogenaamde ‘mensenrechtenclausule’. Op deze manier probeert Mugraby de mensenrechtensituatie in Libanon te verbeteren, aldus zijn advocaten Jeroen Regouw en Leo Spigt.

Volgens het verzoekschrift hebben de instituties van de EU nagelaten om de instrumenten die zij tot hun beschikking hebben, te gebruiken om Libanon ertoe te bewegen de mensenrechten te respecteren. Op deze manier hebben zij bijgedragen aan een ‘toename van de hoeveelheid en ernst van de mensenrechtenschendingen in Libanon, inclusief die tegen Mugraby’.

L4L juicht de beslissing van Mugraby toe om een procedure te beginnen tegen de Europese Unie met als doel het beëindigen van de belemmeringen die Mugraby ondervindt tijdens het uitoefenen van zijn beroep als advocaat. De EU moet inderdaad handelen op grond van art. 2 van het Associatieverdrag met Libanon, waarin uitdrukkelijk wordt gesteld dat respect voor de mensenrechten een speerpunt is van het verdrag. Wanneer Libanon nalaat om de mensenrechten te respecteren, moet de EU inderdaad besluiten tot het stopzetten van de hulp aan Libanon die voortvloeit uit het verdrag.
