Several Dutch Bar Associations, together with Lawyers for Lawyers and more than fifty other legal organizations, have expressed their concerns over the case against the Istanbul Bar Association and its board members, including its president, İbrahim Kaboğlu. The actions taken by the Turkish authorities are at odds with the fundamental principles of a democratic rule of law, namely a free and independent legal profession.
Charges following criticism of journalist murders
The Istanbul Bar Association came under fire after issuing a statement on 21 December 2024, condemning the death of journalists Nazım Daştan and Cihan Bilgin in Syria and calling for further investigation. In response, the Istanbul Public Prosecutor’s Office launched a criminal investigation into the bar’s leadership. The charges include “spreading terrorist propaganda” and “disseminating misleading information”, carrying a maximum sentence of 12 years.
Additionally, on January 14, the Turkish Public Prosecutor initiated legal proceedings to remove the recently elected president, İbrahim Kaboğlu, from office. Shortly thereafter, lawyer and board member Fırat Epözdemir was arrested following a visit to the Council of Europe, accused of “membership in a terrorist organization” and “propaganda for a terrorist organization.” The Turkish legal community suspects these actions are part of political retaliation against the Istanbul Bar Association.
International and Dutch legal community express support
In an initial joint response, more than fifty legal organizations expressed their support for the Istanbul Bar Association and the affected lawyers. During an Extraordinary General Assembly on Sunday, February 23, organized by the Istanbul Bar Association, representatives from Lawyers for Lawyers and the Dutch Bar Associations were present. The Dean of the Northern Netherlands Bar Association, Eef van de Wiel, addressed her Turkish colleagues and handed over a statement of support on behalf of a majority of the Dutch Bar Associations.
On March 4, the deans of the Amsterdam Bar Association, Jacqueline Schaap, and The Hague Bar Association, Inge Aardoom-Fuchs, along with Lawyers for Lawyers, will attend the first hearing in the case in Istanbul. This hearing, and the further course of the proceedings, will be closely monitored as it marks a crucial moment in the fight for the independence of the legal profession and the protection of lawyers’ rights in Turkey. The support and solidarity of international and national organizations and bar associations are essential to exert pressure on the authorities and ensure that the independence of the legal profession is upheld.

Nederlandse Ordes tonen zich solidair met de Orde van Istanbul in reactie op juridische stappen Turkse autoriteiten
Verschillende Nederlandse Ordes, samen met Lawyers for Lawyers en ruim vijftig andere juridische organisaties, hebben hun zorgen geuit over de zaak tegen de Orde van Istanbul en diens bestuursleden, inclusief voorzitter İbrahim Kaboğlu. De acties van de Turkse autoriteiten staan op gespannen voet met de fundamentele beginselen van de democratische rechtsstaat, namelijk een vrije en onafhankelijk advocatuur.
Aanklacht na kritiek op moord journalisten
De Orde van Istanbul kwam onder vuur te liggen na een verklaring op 21 december 2024, waarin zij de dood van journalisten Nazım Daştan and Cihan Bilgin in Syrië veroordeelden en opriepen tot nader onderzoek. In reactie hierop startte het Openbaar Ministerie van Istanbul een strafrechtelijk onderzoek naar het bestuur van de Orde. Niet veel later werd advocaat en bestuurslid Fırat Epözdemir gearresteerd na een bezoek aan de Raad van Europa, op beschuldiging van ‘lidmaatschap van een terroristische organisatie’ en ‘het maken van propaganda voor een terroristische organisatie’. De Turkse juridische gemeenschap vermoedt dat deze acties onderdeel zijn van politieke vergeldingsmaatregelen tegen de Orde van Advocaten van Istanbul.
Internationale en Nederlandse juridische gemeenschap betuigen steun
In een eerste gezamenlijke reactie betuigden meer dan vijftig juridische organisaties hun steun aan de Orde van Istanbul en de getroffen advocaten. Tijdens een Bijzondere Algemene Vergadering op zondag 23 februari, georganiseerd door de Orde van Istanbul, waren vertegenwoordigers van Lawyers for Lawyers en de Nederlandse Ordes aanwezig. De deken van de Orde van Noord-Nederland, mr. Eef van de Wiel, sprak haar Turkse collega’s toe en overhandigde namens een meerderheid van de Nederlandse Ordes een steunverklaring.
Op 4 maart zullen de dekens van Amsterdam, mr. Jacqueline Schaap, en Den Haag, mr. Inge Aardoom-Fuchs, samen met Lawyers for Lawyers de eerste zitting in de zaak bijwonen te Istanbul. Deze zitting en het verdere verloop van de procedure zal nauwlettend worden gevolgd, aangezien het een belangrijk moment zal zijn in de strijd voor de onafhankelijkheid van de advocatuur en de bescherming van de rechten van advocaten in Turkije. De steun en solidariteit van internationale en nationale organisaties en ordes is cruciaal om druk uit te oefenen op de autoriteiten en er zo voor te zorgen dat de onafhankelijkheid van de advocatuur wordt gerespecteerd.
